Terms and Conditions
1. Applicability
1.1 By signing up for a membership at Kraftwerk Heerlen, the member confirms acceptance of these Terms & Conditions. These conditions apply to all agreements between Kraftwerk Heerlen and the member. Use of the facilities is only permitted if the member agrees to these terms.
1.2 Kraftwerk Heerlen reserves the right to update these Terms & Conditions at any time.

2. General
2.1 Contract partner: After signing the membership agreement (the “Agreement”), the named individual becomes a member of Fitnessclub Kraftwerk Heerlen B.V.
2.2 Services: Upon payment, the member may use the agreed-upon services during opening hours.
2.3 Minors: Members under 18 years old require consent from a parent or guardian. Membership is not available to children under 16 years old.
3. Use of Kraftwerk Heerlen
3.1 Access: Entry to the club is granted via an RFID or NFC wristband/tag. Without the wristband/tag, access to the club or additional services is not possible.
3.2 House rules: Members are required to follow all house rules and instructions provided by staff. Violations may result in removal from the club.
3.3 Electronic payments: Purchases within Kraftwerk Heerlen are made using the wristband/tag. Any credit on the wristband/tag is non-refundable.
3.4 Lockers: Kraftwerk Heerlen is not liable for theft or loss of items from lockers.
3.5 Parking: Limited parking is available for a maximum duration of two hours. External parking rules also apply.
3.6 Opening hours: Kraftwerk Heerlen may close or cancel classes during holidays, school breaks, or in cases of force majeure without providing refunds.
4. Member Responsibilities
4.1 Lost wristband/tag: The loss of a wristband or tag must be reported immediately to the club.
4.2 Non-transferable: Membership and the wristband/tag are strictly personal and may not be transferred. Misuse may result in a €150 fine.
4.3 Replacement fee: Failing to return, losing, or damaging a wristband/tag will incur a €20 fee.
4.4 Changes: Members must promptly report any changes to their personal information.
5. Membership Fees & Payments
5.1 Monthly payments: Membership fees are paid monthly in advance, per calendar month.
5.2 Pro-rata: If a membership starts before the first of the month, the partial period is charged on a pro-rata basis.
5.3 Failed payments: Additional fees may be charged for failed payments, including a €10 administrative fee.
5.4 Default: Access to the club may be blocked and membership may be terminated in case of non-payment.
5.5 Additional services: Services provided by external parties, such as personal training, are invoiced separately.
5.6 Annual indexation: Membership fees may be increased once per year by up to 5%.
5.7 Registration fee: A one-time registration fee of €50 applies to all memberships.
6. Duration & Cancellation
6.1 Memberships are offered for durations of 1, 6, or 12 months. Cancellation must be submitted in writing at least one calendar month prior to the end of the contract. If not cancelled, the membership is automatically renewed with a one-month notice period. Fees remain due even if the facilities are not used. Flexible memberships follow the same cancellation rules.
7. Suspension or Termination
7.1 Suspension: Membership may be paused for up to six months in cases of illness, pregnancy, or injury, provided a medical note from a doctor is submitted.
7.2 Relocation: If a member moves more than 20 kilometers from Kraftwerk Heerlen, termination with one month’s notice is permitted, provided proof of relocation is submitted.
7.3 Cancellation process: After the contract period ends, cancellation is only accepted via the official cancellation form (online, by email, or at the front desk). A confirmation email will be sent, and the date in this email is considered final. Mid-term cancellation is not possible.
8. Conduct in the Club
8.1 Prohibited substances: Smoking, alcohol, drugs, and performance-enhancing substances are strictly forbidden. Violations may result in immediate termination of membership and a €150 fine.
8.2 Respect: Members are expected to respect other members and staff. Misconduct may result in removal from the club.
9. Liability
9.1 Own risk: Training at Kraftwerk Heerlen is entirely at the member’s own risk.
9.2 Responsibility: Kraftwerk Heerlen is only liable where legally required. The club is not liable for injuries, theft, accidents, property damage, or any kind of loss. Dutch law applies to all agreements.
9.3 Injuries: Kraftwerk Heerlen is not responsible for injuries caused by improper use of equipment, ignoring staff instructions, or any other incidents.
10. Force Majeure
10.1 Kraftwerk Heerlen is not required to fulfill obligations if prevented by force majeure. This includes staff illness, epidemics, natural disasters, strikes, or problems with third-party providers.
10.2 In the event of closures, cancellations, or changes due to force majeure, no refunds will be provided.
11. Privacy
11.1 Data processing is carried out in accordance with the General Data Protection Regulation (GDPR).

12. Additional Provisions
12.1 Reservation system: Some services require reservations. Rules regarding cancellations, no-shows, and availability apply and may change without notice.
12.2 Social media code: Posting photos or videos of other members without their permission is not allowed in order to protect privacy.
12.3 Pets: Pets are not allowed, with the exception of certified assistance dogs.
12.4 Misconduct: Kraftwerk Heerlen may suspend or terminate membership in cases of repeated misconduct or violation of house rules.
12.5 Intellectual property: Using Kraftwerk Heerlen logos, brands, or copyrighted material without permission is prohibited.
12.6 Complaints: Complaints can be submitted in accordance with the official complaints procedure, which is available online and at the reception desk.
12.7 Special protocols: Members must follow specific protocols when applicable (such as COVID-19 rules, tanning-bed rules, and sanitation rules). These protocols are communicated on-site or through the club’s website.
Cancellation Rights
You have the right to cancel your online membership with Kraftwerk Heerlen within fourteen days, without needing to provide a reason. This 14-day period begins on the date your membership agreement is activated, which is confirmed once you receive the confirmation email after accepting the online offer.
How to Exercise Your Right of Withdrawal
If you wish to make use of your cancellation right, you must inform Kraftwerk Heerlen of your decision to withdraw from the agreement. This can be done through a clear written statement—by post, email, or fax. Although we provide a cancellation form for convenience, you are not required to use it. What matters is that you communicate your intention to withdraw before the 14-day withdrawal period expires.
Refund Process After Withdrawal
If you decide to withdraw your membership, we will refund all payments received from you without unnecessary delay. Refunds will be issued no later than fourteen days after the day we receive your withdrawal notice. The refund will be processed using the same payment method you used for the original transaction, unless we have mutually agreed on a different method. No additional fees will be charged for issuing the refund.
